My Gym is Drawing on Expired Debit Card (legal)?
Quick data points:
1 )Opened gym membership in 2003 using debit card to draw month dues (both GYm and Bank are in California)
2) Debit card expired August 2005
3) I was under the assumption that if the debit card expired the gym could not charge my account
4) I just checked my bank account and realized the gym has been putting through my credit card every month (post expired date)
5) I never cancelled my membership thinking that my expired debit card would accomplish this like other services that don’t allow you to continue to receive services with an invalid credit card
Questions:
Do I have any recourse?
if yes, Gym, Merchant Provider or my Bank

P.S. I should have formally sent a termination letter back in ‘05, but, I did not…….and I’m a moron for not doing so, BUT, an answer to my questions is much appreciated

Jason2944 reiterated what BofA told me. Well there goes $2K. Maybe for good measures I should spend another $500 by filing a claim against BofA at the local courthouse forcing BofA to hire a local attorney to show up and represent BofA. Just think this could cost BofA at least $2k in retainer fees. Thanks, Jason2944
